Covington’s online content practice combines our broad knowledge of long-standing FCC rules with our current work on new laws affecting online content, including the laws or proposed bills affecting spam, spyware, privacy, children’s protection, obscenity and data protection.  This practice is both advisory, telling clients what the current rules are and whether they apply to some activity, and advocacy, informing both Congress and the FCC why certain online content activity should not be covered or how any legislative proposals should be crafted.  In this regard, we work closely with companies in allied industries and participate frequently in ad hoc industry working groups and more formal coalitions.

Representative Matters

  • Net Neutrality.  Covington has represented the coalition of Internet-based content companies (Amazon.com, eBay, Google, IAC, Microsoft, and Yahoo!) advocating for Congress to adopt rules ensuring broadband network operators do not discriminate.  This legislative work builds on our work for these companies before the FCC. 
  • Consent Order.  Covington negotiated a Consent Order with the Federal Trade Commission, and a related agreement with EU authorities, involving the security of providing information through an online authentication service, and assisted in the creation of an Information Security Policy and Program conforming to the requirements of the Consent Order.
  • National Football League.  Covington represented the NFL in negotiating its $18 billion eight-year programming agreements with ABC, CBS and Fox Television and its interactive media rights/online cross-promotion and marketing agreement with AOL, CBS and Sportsline.com.
